privacy AND AI LEGISLATION
In the U.S., 19 states have enacted privacy laws, six states and New York City have enacted AI laws. Approximately 144 countries now have enacted national data privacy laws, and a few countries have enacted AI laws. Of course, the U.S. Federal Trade Commission should not be forgotten.
It used to be that privacy and AI governance only was an issue for global businesses. That no longer is the case. If your business only is located in the U.S., you need to pay attention to these U.S. privacy and AI laws because all of the state privacy laws have enforcement provisions. Also, seven states have formed a Consortium of Privacy Regulators to, among other things, coordinate their enforcement efforts. Importantly, the Texas Attorney General has emerged as a significant regulatory enforcement authority (it has entered into a $1.375 billion settlement with Google over alleged unlawful processing of geolocation and biometric information and “incognito searches” in private browsers). Texas soon may rival the California Attorney General and the California Privacy Protection Agency in aggressive enforcement of these laws.
