U.S. Businesses STILL need to pay attention to U.S. AI and Privacy Laws

Despite the issuance of a Presidential Executive Order prohibiting state AI laws that are unduly burdensome, ideologically driven, or incompatible with the First Amendment, businesses ignore state AI and privacy laws and regulations at their peril. Seven states have AI laws and regulations, and 19 U.S. states that cover more than 50 percent of the U.S. population have comprehensive privacy laws. Depending on how the term “profiling” is defined in a state’s privacy law, some AI activities may be covered by a state’s privacy law as well.

U.S. businesses need to pay attention to these privacy and AI laws because all of the state privacy laws have enforcement provisions and because attorneys general from seven states, as well as the California Privacy Protection Agency, have joined together to create the Consortium of Privacy Regulators. This bipartisan coalition was formed to coordinate enforcement efforts and promote consistent interpretation of state privacy laws. The Consortium’s goal is to protect consumer privacy rights and ensure businesses are held accountable for violations. The seven states are: California, Colorado, Connecticut, Delaware, Indiana, New Jersey, and Oregon.
